Privacy Policy

This Privacy Policy explains how information about you is collected, used and disclosed by The Youth Pawa Organization (“we”, “our”, “us”, “YoPA” or the “Organization”). This Policy applies to information we collect when you use our websites, mobile sites and other online services that link to this Privacy Statement (collectively, the “Sites”) or when you otherwise interact with us, such as by participating in our activities. The Policy is in accordance with the Kenya Data Protection Act (2019), the Kenya Data Protection Regulations 2021 and applicable regulations such as the EU General Data Protection Regulation (GDPR).

For the purpose of the General Data Protection Regulation (the “GDPR”), we are the data controller we use your Personal Data only in accordance with the following principles and in compliance with applicable data protection laws including the GDPR. 

We may change this Policy from time to time. If we make changes, we will notify you by revising the date at the bottom of the Policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you an email notification). We encourage you to review this Privacy Policy whenever you access the Sites to stay informed about our information practices and how you can help protect your privacy.

Collection of Information

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information when you sign up to receive email or newsletter updates, fill out a form, send us an email, communicate with us via third-party social media sites, request information, respond to our requests, or otherwise communicate with us. We also collect information about you when you make a donation, attend one of our events, or participate in one of our activities.

You may also provide us with Personal Data related to other people, for example, to nominate a community member or recommend someone for employment. As part of this process, you will need to provide Personal Data, such as name, contact information, location, organization, fields of work, and other related information, to us about persons other than yourself. You agree to and confirm that you have sought and received consent to share such person’s Personal Data with us prior to submission. Youth Pawa will confirm this consent within one (1) month of receipt using the provided contact information. In the absence of consent confirmation, Youth Pawa will delete such Personal Data.

Information We Collect When You Use the Sites

The Site’s web servers collect standard internet log information during user visits to the Site. This information is used to assist with troubleshooting issues with the Site including performance and security-related functions. In addition to server logs, the Site also uses the Google Analytics service to help us assess how users access and utilize the Site by collecting bits of information such as statistical usage. This information is used to create aggregate statistics about the operation and use of the Site such as when the Site is accessed, the pages which refer visitors to the Site, and other information that helps us understand how the Site is used and how it might be improved in the future.

We use various technologies to collect information, and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Sites and your experience, see which areas and features of our Sites are popular and count visits. We may also collect information using web beacons (also known as “tracking pixels”). Web beacons are electronic images that may be used in our Sites or emails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon. 

Information We Collect From Other Sources

We may also obtain information from other sources and combine that with information we collect through our Sites or otherwise through our interactions with you. We also may collect information from data aggregators, who can assist with updating contact information or giving profiles, or reviewing publicly available information (e.g., web and social media). We generally use such data to more effectively identify or connect with current and potential audiences and supporters.  We may also rely on publicly available information in reviewing applications from individuals or other stakeholders seeking to work with the Organization.

The Organization is based in Kenya but operates globally. We process and store information in Kenya and other countries. Where required by applicable law, we will take steps to ensure that information about you receives an adequate level of protection where we are processing it.

Social Sharing Features

The Sites may offer social sharing features and other integrated tools (such as the Facebook “Like” button), which let you share actions you take on our Sites with other media, and vice versa. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. Linked Sites

The Sites may contain links to the websites of other companies and organisations which may be of interest. However, once you have used these links to leave our Website, you should note that we do not have any control over that other Website. Therefore, we cannot be responsible for the protection and privacy of any Personal Information which you provide whilst visiting such sites and such sites are not governed by this Privacy Policy. You should exercise caution and look at the privacy policy applicable to the Website in question.

Children

We understand the importance of protecting the privacy of children. We only collect minimal personal information from children participating in our programs, such as their names. This information is solely used for planning and logistical purposes to ensure a safe and enjoyable experience.

Prior to collecting any information from children under 18, we will always obtain authorization from their legal guardians or persons in charge. We may also use photographs of children engaged in our activities on our website or social media pages. However, this will only be done with the explicit permission of their legal guardians or persons in charge.

If we become aware that we have unknowingly collected Personal Information from a child under the age of 18, we will make all reasonable efforts to delete such information from our database. If you have any concerns or believe we may have unknowingly collected personal information from a child under 18, please do not hesitate to contact us immediately at privacy@theyouthpawa.org.

Filming & Photography

Please note that we (or our service providers) or third-party (including partners) event hosts may film or photograph those attending or taking part in our events. We may use the footage or photographs for publicity and marketing/ fundraising purposes. For example, in print and/or digital material (including social media) or via external advertising and press outlets, all of which may be made available to the public.

No personal details (e.g. names) of children under 18 will be used in such materials without consent from their parent or legal guardian, but we may use images where children are incidentally pictured (for example, as part of a crowd).

Campaign Communications

We may use your contact details to provide you with information about our work which we consider may be of interest to you. We will obtain your consent to contact you via email for these purposes. We send the following marketing materials:

You can opt out of receiving marketing communications from us at any time using the details in the “Contact Us” section. Please note that we may still send you administrative communications where necessary.

Administrative communications

In addition to the campaign communications that you receive from us, we will also communicate with you by post, and e-mail about administrative matters. On occasion, we will also contact you about an event that you have signed up to participate in, for example, to check that fundraising pages have been set up and to provide any other necessary information. We may still need to communicate with you for administrative purposes even if you have opted out of marketing communications from us.

Data Retention

We store the information we collect about you for as long as is necessary for the purpose(s) for which we originally collected it, or for other legitimate business purposes as is permitted by the Privacy Policy, including to meet our legal, regulatory, or other compliance obligations.

Security

We take proportionate and appropriate measures to safeguard your personal information and to prevent the loss, destruction, misuse or alteration of it.

We ensure that any information sent to us is encrypted (scrambled) using Secure Socket Layer (SSL) technology. This is industry-standard encryption technology that prevents your Personal Information from being intercepted and misused by third parties.

Please keep in mind that no Internet transmission is 100% secure. Some emails sent to or from our Website may not be secure. Please consider this when sending information to us by email.

Your Rights

Subject to certain limitations, you have the right to access personal data we hold about you and to ask that your personal information be corrected, erased, or transferred. You may also have the right to object to or request that we restrict certain processing. 

To exercise any of these rights, please send us a description of the personal information in question, along with an explanation of the rights you wish to exercise, using the email privacy@theyouthpawa.org. In some cases, we may ask for proof of identification or further information before we can process your request.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Changes to this Privacy Policy

We keep this Privacy Policy under regular review and may update it from time to time, so we recommend that you check it regularly. Where necessary we may also notify you of changes to this Policy by email.
